If a factory releases toxic fumes into the air and those fumes make you sick, you might think you need to prove the factory was careless. In many cases, you do not have to. Under a legal doctrine called strict liability, the factory can be held responsible for the harm its fumes cause even if it followed every safety rule and did nothing wrong. Strict liability removes the requirement to show negligence. You do not need to prove that the company cut corners, ignored warnings, or acted recklessly. Instead, you only need to show three things: that the activity was abnormally dangerous, that the fumes escaped, and that the fumes caused your injuries. Courts have long recognized that certain industrial activities are so risky, and have such potential for catastrophic harm, that those who choose to engage in them must bear the full cost of any damage, regardless of how careful they are.
What makes an activity abnormally dangerous? Courts look at several factors. Is there a high risk of serious harm? Can the harm be eliminated through reasonable care? Is the activity uncommon in the area? Does its value to the community outweigh the risk it creates? Chemical manufacturing, oil refining, and large-scale pesticide application often qualify. They install redundant safety systems, monitor air quality continuously, and maintain generous insurance policies. Even with those measures, a lawsuit can be devastating. A single fume release that sickens fifty households can result in settlements or verdicts worth millions of dollars. Critics argue that strict liability stifles economic growth and forces factories to relocate to less regulated areas. Supporters counter that it is the price of operating a dangerous business in a community that did not ask for the risk.
